EMAIL POLICY

By submitting your email address on our website, you consent to be contacted by Gwen’s Girls. We will only use your contact information to send you information related to Gwen’s Girls. You always have the option of opting out of our list of contacts.

We do not sell, trade, or otherwise transfer your information to outside parties.

DONOR RIGHTS

Gwen’s Girls will not disclose privileged or confidential information. No donor or prospect information will be disclosed. Donors have the opportunity to remove their names from any and all lists. Gwen’s Girls does not sell, rent or exchange donor lists with other organizations.

The official registration and financial information of Gwen’s Girls, Inc. may be obtained from the Pennsylvania Department of State by calling toll free within Pennsylvania: 1-800-732-0999. Registration does not imply endorsement.

HIPAA

Information that relates to your child’s or your health or treatment and that identifies you is protected under the Health Insurance Portability and Accountability Act (HIPAA) of 1996. This protection covers both written and electronic information. This protection lasts as long as the information is in the hands of Gwen’s Girls, Inc.

Notice
This notice describes how your child’s or your treatment and health information may be used and disclosed by Gwen’s Girls. Please review it carefully and ask the Gwen’s Girls staff who gave this to you if you have any question regarding this notice.

Consumer/Patient Rights
You have the right to know HOW your child’s or your health information and service records will be used, and WITH WHOM the information will be shared.

You have the right to GIVE INFORMED CONSENT before providers can use or share your child’s or your health and service information, even for routine purposes such as treatment, payment, and the operation of services delivered by Gwen’s Girls. Providers may require that treatment and participation in services be based upon obtaining your consent.

You have the right to REFUSE CONSENT to share your child’s or your health information. If you do give consent, you have the right to restrict information if it is to be used for non-routine purposes, such as marketing and fundraising.

You have the right to ASK FOR RESTRICTIONS OR LIMITS on release of your child’s or your information (such as requesting that information not be shared with a particular individual). This request should be documented in writing and sent to Gwen’s Girls. Gwen’s Girls will notify you in writing as to whether your request can be honored.

You have the right to ask that COMMUNICATIONS from those requesting information be made IN A CERTAIN WAY (such as no phone calls, written requests only). Your request will be honored unless it is unreasonable and creates too great a burden for Gwen’s Girls staff.

You have the right to SEE AND COPY your child’s or your health and service information kept by Gwen’s Girls, and to be provided documentation on who has been able to see this information. You may be restricted from seeing your child’s or your file if a medical professional determines that this may cause you physical harm.

You have the right to ASK FOR A CHANGE to your child’s record if you believe it contains incorrect or unnecessary information. Your request must be sent in writing to Gwen’s Girls. The Privacy Officer will decide whether your request can be honored, and will notify you of the decision in writing.

Your child’s file records are maintained on site for every program service in which you all are actively involved. Upon termination of a given service, your child’s record will continue to be maintained on site until further request or expiration of six (6) years from the date of discharge.

Records will be destroyed by administration staff of Gwen’s Girls.

Information Sharing
The information from your child’s record that is shared must be limited to what is necessary for that specific incidence, except if the information is to be shared for treatment purposes, then the entire record may be shared.

Gwen’s Girls has established business practices to protect the privacy of your child’s records. These include employee training, naming a Privacy Officer to assist with complaints, and establishing business guidelines for privacy with others who have contracts with, or share information with, Gwen’s Girls.

Gwen’s Girls will SHARE your child’s or your health and service record INFORMATION IN RESPONSE TO A SUBPOENA, COURT ORDER, OR WARRANT, WITHOUT YOUR ADDITIONAL CONSENT. You will be notified in writing should such a request be received.

Your child’s or your INFORMATION MAY BE SHARED WITH Gwen’s Girls FUNDERS (e.g., United Way of Allegheny County, Community Care Behavioral Health Organization, Medical Assistance Office. Please contact the privacy officer for a detailed list of all Gwen’s Girls funders.) OR GOVERNMENT MONITORS (e.g., Allegheny County Department of Human Services — Office of Children, Youth and Families, Office of Behavioral Health, PA Department of Public Welfare) WITHOUT YOUR ADDITIONAL CONSENT.

Your child’s or your INFORMATION MAY ALSO BE SHARED for public health activities WITH THE ALLEGHENY COUNTY HEALTH DEPARTMENT WITHOUT YOUR ADDITIONAL CONSENT.

Other uses and disclosures of your child’s or your health information will only be made with your explicit written authorization.

Complaints
You may ask a question about your child’s or your rights or file a complaint with Gwen’s Girls’ Privacy Officer, the United States Secretary of Health and Human Services, or the Office of Civil Rights Compliance (at 1-866-627-7748) if you believe your child’s or your privacy rights have been violated.
